A registered trademark is still subject to attack by a third party who can seek to have the registration cancelled or to have your rights under the registration limited. The two procedures for making such a challenge are known as a “Section 45 proceeding,” which is initiated with the Trade-marks Office and a “Section 57 application,” which is commenced at the Federal Court of Canada.
If you wish to challenge a trademark registration, we can advise you with respect to your options and represent you in the proceedings. If your trademark registration has been challenged, we can represent you in your defence against a Section 45 or Section 57 notice.
